How Consumer Rights Affect this PlanTHE BENEFITS CONFERRED BY THIS PLAN ARE IN ADDITION TO, AND DO NOT PREJUDICE, ANY RIGHTS AND REMEDIES PROVIDED UNDER APPLICABLE CONSUMER PROTECTION LAWS AND REGULATIONS. THIS PLAN SHALL NOT PREJUDICE THE RIGHTS GRANTED TO YOU UNDER STATUTORY WARRANTY LAW AND TO SEEK DAMAGES IN THE EVENT OF NON-PERFORMANCE BY TLS OF ANY OF ITS CONTRACTUAL OBLIGATIONS.

Where any provision of this Plan conflicts with mandatory consumer-protection law in the jurisdiction in which you purchased the Plan, the mandatory law will prevail to the extent of the conflict, and the remainder of this Plan will remain in full force and effect.

 

1. The Plan

This contract (the “Plan”) governs the services provided by TLS under the TLS Protection Plan and includes the terms in this document, your Plan Confirmation (“Plan Confirmation”), and the original sales receipt for your Plan. Your Plan Confirmation will be provided to you at the time of purchase or sent to you automatically thereafter.

Benefits under this Plan are additional to your rights under applicable law, any manufacturer’s limited warranty, and any complimentary technical support. The terms of the Plan apply the same whether for a monthly recurring term of coverage (“Monthly Plan”) or for an annual recurring term of coverage (“Annual Plan”), except where otherwise noted. Your Plan may be paid by you or a third party who finances or otherwise pays for your Plan (a “Plan Payment Provider”).

The Plan covers the following equipment (collectively, the “Covered Equipment”):

  • (i) the TLS-branded product listed on your Plan Confirmation (the “Covered Device”), being one of:The Watch, a wearable device by The Light System.
  • and (ii) the original accessories contained inside the original packaging of your Covered Device.​

The Covered Equipment must have been purchased as new from TLS directly. Covered Equipment includes any replacement product provided by TLS under this Plan.

Cover Limit Per Device: The TLS Protection Program is valid for one (1) eligible TLS Watch per active Protection Plan subscription. Each TLS Watch must be covered by its own separate Protection Plan subscription. If a customer purchases multiple TLS Watches, a separate Protection Plan must be purchased and maintained for each individual device to receive coverage. Devices without an active Protection Plan are not eligible for benefits, repairs, replacements, or claims under the TLS Protection Plan.  Coverage is non-transferable between devices and may not be reassigned from one device to another unless expressly authorized in writing by The Light System. In the event of a claim, The Light System reserves the right to verify the serial number (Mac number for The Watch), purchase information, and active Protection Plan status of the covered device. 

Enrollment Window: The Plan may be purchased only within sixty (60) days of the original purchase of the Covered Device.

This Plan applies only to your Covered Equipment. This Plan is not intended for commercial use. TLS has the right to monitor service requests to ensure compliance. Violation of this provision may void this Plan.

Plan coverage begins on the later of (i) the date the Plan is purchased and (ii) the date the Covered Device is delivered to you. Coverage continues, unless cancelled in accordance with Section 9, through the date specified in your Plan Confirmation (the “Plan Term”).

Minimum Commitment: All TLS Protection Plans are subject to a minimum commitment period of twelve (12) months from the Plan start date (the “Minimum Commitment Period”). This applies to both Monthly Plans and Annual Plans. Cancellation during the Minimum Commitment Period is subject to the terms of Section 9.

Automatic Renewal: The TLS Protection Plan automatically renews annually unless canceled before the renewal date. Devices enrolled during the applicable enrollment window may renew coverage for additional annual terms as long as the Protection Plan remains active and in good standing. If coverage is canceled, expires, or lapses for any reason, the device may become ineligible for future enrollment or reinstatement. The Light System reserves the right to modify renewal pricing, coverage, or plan terms upon renewal. Continued renewal constitutes acceptance of any updated terms. 

2. Plan Term

The plan will be active for 1 calendar year beginning from the date of plan purchase.

3. What is Covered?

3.1 Hardware Service for Defects (“Hardware Service”)Hardware Service is provided if a defect in materials or workmanship arises during the Plan Term.

 

3.2 Accidental Damage from Handling (“ADH Service”)

Your TLS Protection Plan includes coverage for up to two (2) approved accidental damage claims per 12-month coverage period. Each approved accidental damage claim is subject to a $59 deductible, which must be paid before a replacement device is issued. Coverage applies only to eligible accidental damage events as defined in these Terms and Conditions. Once two accidental damage claims have been used during a coverage period, no additional accidental damage claims will be covered until the plan renews.

 

3.3 Theft and Loss Service (“Theft and Loss Service”)

Theft and Loss Service is included with every Plan. To be eligible for coverage, you must report the incident within thirty (30) days of discovery, provide a police report for theft claims, and cooperate fully with the claims process. 

 

Limits: Coverage is limited to one (1) combined Theft or Loss claim per 12-month coverage period. Each approved Theft of Loss claim is subject to a $109 deductible, which must be paid before a replacement device is issued.

 

3.4 Fulfillment of Service

TLS will, at its discretion: (i) repair the Covered Device using new or refurbished genuine TLS parts, or (ii) replace it with a new or refurbished unit of comparable value. If neither is possible, TLS will issue store credit equal to the greater of the current retail price or your original purchase price. Replacements carry the remainder of the Plan Term.

3.5 Service Fees and Service EventsEach service request is a “Service Event.” Service Fees (deductibles) are as follows:

Covered Device: The Light System Watch

1 Year Premium: $50/USD

ADH Service Fee: $59/USD

Theft/Loss Service Fee: $109/USD

Mechanical / Electrical Failure Fee: $0/USD (for the first 12-month term, only)

Battery Failure Fee: $0/USD (for the first 12-month term, only)

3.6 Technical SupportPriority email and web-based technical support is included for the duration of the Plan Term.

4. What is Not Covered?

Standard exclusions include normal wear and tear (including normal patina on copper), cosmetic damage, intentional misuse, reckless conduct, unauthorized modifications, pre-existing conditions, and commercial use.

5. How to Obtain Service

Contact TLS support with your Plan details and device serial number. For ADH and Hardware claims, photo/video verification of damage and serial number (Mac number for The Watch) is required. For theft, a police report is mandatory within 30 days of the incident. For loss, a claim must be made within 30 days of the incident.

Verification at Enrollment: You may be required to submit photo or video of the Covered Device showing its condition and serial number (Mac number for The Watch) at enrollment.

6. Service Options & Shipping

TLS pays outbound shipping. You are responsible for inbound shipping where required (e.g., The Watch) and all taxes, tariffs, and duties. Photo/video-based replacement may be offered for smaller items without requiring return of the damaged device.

7. Your Responsibilities

Provide accurate information, follow instructions, back up any data, and return devices when required. During service, data may be erased and the device restored to factory settings.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TLS’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PLAN PLUS THE RETAIL VALUE OF THE COVERED DEVICE. TLS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

 

9. Cancellation

The plan may not be cancelled or refunded once purchased.

10. Transfer of Plan

One-time permanent transfer allowed upon sale of the device, only with notification/approval to/from TLS.

 

11. Plan Changes

TLS may revise terms with sixty (60) days’ notice.

 

12. General Terms

Standard provisions apply including force majeure, severability, no waiver, and entire agreement.

 

13. Governing Law and Dispute Resolution

 

(a) Governing Law: This Plan is governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles.

 

(b) Dispute Resolution:Disputes shall first be addressed through good-faith mediation. If unresolved within thirty (30) days, the dispute shall be resolved by mandatory and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Wyoming.

Jury Trial Waiver: Both parties knowingly and voluntarily waive any right to a jury trial.

Class Action Waiver: Both parties waive any right to class, collective, or representative actions to the extent permitted by law.

By purchasing the TLS Protection Plan, you expressly agree to the Protection Plan Terms & Conditions, including all coverage limitations, exclusions, claim procedures, eligibility requirements, cancellation provisions, and dispute resolution terms. Your purchase constitutes acceptance of these terms and forms a binding agreement between you and The Light System.
